Article 1. Definitions

Seller means the trader operating birdjk.com, registered with the Dutch Chamber of Commerce under number 78428084.

Consumer means a natural person who is not acting for purposes related to a trade, business, craft or profession.

Agreement means the distance contract formed between Seller and Consumer through the webshop.

Cooling off period means the period during which the Consumer can exercise the right of withdrawal.

Right of withdrawal means the ability of the Consumer to cancel the distance contract within the cooling off period.

Day means calendar day, unless stated otherwise.

Article 2. Applicability

2.1 These terms apply to every offer made by Seller and to every agreement concluded at a distance between Seller and Consumer.

2.2 Before an agreement is concluded, the text of these terms is made available to the Consumer. Where this is not reasonably possible, Seller will indicate, before the agreement is concluded, how the terms can be viewed, and will send them free of charge as soon as possible on request.

2.3 If the agreement is concluded electronically, these terms may be provided electronically, in a way that allows the Consumer to store them on a durable medium.

2.4 If specific product or service terms apply in addition to these general terms, the second and third paragraphs apply accordingly, and in the event of conflicting terms, the Consumer may rely on whichever provision is most favourable.

Article 3. The offer

3.1 If an offer is subject to a limited period of validity or specific conditions, this is clearly stated.

3.2 The offer contains a complete and accurate description of the products, sufficient to allow a proper assessment by the Consumer. Images are a true representation of the products offered, though minor deviations in colour due to screen display cannot be fully ruled out. Obvious mistakes or errors in the offer do not bind Seller.

Article 4. The agreement

4.1 Subject to Article 4.4, the agreement is concluded at the moment the Consumer accepts the offer and meets the corresponding conditions.

4.2 If the Consumer has accepted the offer electronically, Seller confirms receipt of that acceptance by electronic means without delay. Until receipt has been confirmed, the Consumer may dissolve the agreement.

4.3 Seller will take appropriate technical and organisational measures to secure the electronic transfer of data and will ensure a secure web environment for payment.

4.4 Seller may, within the boundaries of the law, verify whether the Consumer can meet payment obligations, and may decline an order or attach conditions to it on reasonable grounds.

4.5 Seller will send, at the latest on delivery, the following information in writing or in a way that can be stored by the Consumer: the visiting address of Seller's place of business for complaints, the conditions and manner in which the right of withdrawal can be exercised, information about guarantees and existing after sales service, the price including all taxes, the cost of delivery where applicable, and the way the agreement can be terminated where it runs longer than a year.

Article 5. Right of withdrawal

5.1 For products, the Consumer can dissolve the agreement without giving reasons for at least 14 days, starting the day after receipt of the product by the Consumer or a third party designated in advance.

5.2 During this period, the Consumer will handle the product and its packaging with care. The Consumer may unpack or use the product only to the extent necessary to assess its nature, characteristics and functioning, as if inspecting it in a shop.

5.3 The Consumer is only liable for any reduction in value of the product resulting from handling the product beyond what is permitted in Article 5.2.

5.4 The Consumer is not liable for reduction in value if Seller has not provided all legally required information about the right of withdrawal before the agreement was concluded.

Article 6. Exercising the right of withdrawal

6.1 During the cooling off period, the Consumer will notify Seller using the model withdrawal form, or in another unambiguous way.

6.2 Once notified, the Consumer must return the product, or hand it to Seller or an authorised representative, within 14 days.

6.3 The Consumer returns the product with all delivered accessories, in original condition where reasonably possible, and following reasonable and clear instructions from Seller.

6.4 The risk and burden of proof for correctly and timely exercising the right of withdrawal rests with the Consumer.

6.5 The Consumer bears the direct cost of returning the product, unless Seller has failed to state that this cost falls to the Consumer.

6.6 Seller offers a digital withdrawal option through the shop, in line with legal requirements that came into force on 19 June 2026, in addition to the model form and email.

Article 7. Obligations of Seller during the cooling off period

7.1 Seller will refund all payments made by the Consumer, including standard delivery costs charged, without delay and within 14 days following the day on which Seller was informed of the withdrawal.

7.2 Unless Seller offers to collect the product, Seller may wait with reimbursement until the product has been received back, or until proof of return shipment has been received, whichever comes first.

7.3 Seller uses the same payment method for reimbursement as the Consumer used, unless the Consumer agrees to a different method, and no additional cost is charged for the reimbursement.

Article 8. Exclusion of the right of withdrawal

Seller can only exclude the right of withdrawal for products described clearly and in good time within the offer, and only for products such as those made to the Consumer's specifications, personalised items, or sealed goods unsuitable for return for reasons of health protection or hygiene once unsealed. Where none of these apply to a product, the standard right of withdrawal in Articles 5 to 7 stands.

Article 9. Price

9.1 During the validity period stated in the offer, prices of products will not increase, except for VAT rate changes.

9.2 Prices stated include VAT.

9.3 All prices are subject to typing and printing errors. No liability is accepted for the consequences of such errors. Where a price error is obvious, Seller is not obliged to deliver at the incorrect price.

Article 10. Conformity and warranty

10.1 Seller warrants that products meet the agreement, the specifications stated in the offer, reasonable requirements of soundness and usability, and legal provisions and government regulations in force at the date of the agreement.

10.2 Any statutory warranty rights of the Consumer are not affected by this Article and apply according to Dutch law, in particular Book 7 of the Dutch Civil Code.

10.3 If a delivered product does not conform to the agreement, the Consumer should contact Seller, describing the fault, within a reasonable time after discovery.

Article 11. Delivery and execution

11.1 Seller will take the greatest possible care when receiving and executing orders for products.

11.2 The place of delivery is the address the Consumer has made known to Seller.

11.3 Seller will execute accepted orders with due speed, and at the latest within 30 days, unless a longer delivery period has been agreed. If delivery is delayed, or an order cannot be fully or partly executed, the Consumer is informed of this no later than 30 days after placing the order, and may in that case dissolve the agreement without cost.

11.4 After dissolution under the previous paragraph, Seller will refund the amount paid by the Consumer without delay.

11.5 The risk of damage or loss of products passes to the Consumer at the moment the products are delivered to the Consumer, unless otherwise agreed.

Article 12. Complaints procedure

12.1 Seller has a sufficiently publicised complaints procedure and handles complaints under this procedure.

12.2 Complaints about the execution of the agreement must be submitted to Seller, described fully and clearly, within a reasonable time after the Consumer has identified the defects.

12.3 Complaints submitted to Seller are answered within 14 days from the date of receipt. Where a complaint requires a longer processing time, Seller will respond within 14 days with an acknowledgement of receipt and an indication of when a more detailed answer can be expected.

Article 13. Disputes

13.1 Agreements between Seller and Consumer to which these terms apply are governed exclusively by Dutch law.

13.2 Disputes may be submitted to the competent Dutch court, or, where Seller is affiliated with such a body, to a recognised Dutch dispute committee such as De Geschillencommissie.

Article 14. Additional or different provisions

Additional provisions or provisions deviating from these terms may not be to the disadvantage of the Consumer, and must be recorded in writing or in a way that can be stored by the Consumer.

Article 15. Intellectual property

All content on birdjk.com, including text, images, logos and design, is the property of Seller or its licensors and may not be copied or reused without prior written permission.

Article 16. Privacy

Personal data provided when placing an order is processed in accordance with Seller's Privacy Policy, published separately on the website.

Article 17. Amendments

Seller may amend these terms. Amendments take effect 30 days after being published, or immediately for new orders placed after publication.
