Article 1. What data we collect
1.1 When you place an order, we collect your name, delivery address, billing address if different, email address, phone number, and details of the products ordered.
1.2 When you sign up for our newsletter, we collect your email address, and your name if you provide it.
1.3 When you browse the site, certain technical data is collected automatically through cookies and similar technology, including IP address, browser type, pages viewed, and how you arrived at the site.
1.4 We do not collect or store your full payment card or bank details ourselves. These are entered directly with our payment providers, described in Article 4.
Article 2. Why we process your data
2.1 Order data is processed to conclude and carry out the purchase agreement with you, including delivery, invoicing, handling returns, and dealing with any warranty or complaint. The legal basis is performance of a contract.
2.2 Some order data, particularly invoices, is kept to meet our bookkeeping obligations under Dutch tax law. The legal basis is a legal obligation.
2.3 Newsletter data is processed to send you marketing emails about products, offers, and updates from birdjk.com, only after you have signed up. The legal basis is your consent, which you can withdraw at any time.
2.4 Data collected through the Meta/Facebook Pixel is used to measure how well our advertising performs and to show relevant ads to people who have visited our site. The legal basis is your consent, given through the cookie banner on the site.
Article 3. Cookies
3.1 Some cookies are strictly necessary for the webshop to function, such as keeping items in your basket, and these do not require consent.
3.2 The Meta/Facebook Pixel places a cookie that is not strictly necessary, and is only activated if you accept marketing cookies through our cookie banner. You can withdraw this consent at any time through the same banner or your browser settings, and doing so will not affect your ability to place an order.
3.3 If you decline marketing cookies, the Meta Pixel will not be active on your visit.
Article 4. Who we share data with
4.1 Payment data is shared with our payment providers, Mollie B.V. for iDEAL and related payment methods, and Wix Payments, for the purpose of processing your payment securely. Neither Ralfos nor birdjk.com has access to your full card or bank account details.
4.2 The site itself is built and hosted on Wix, provided by Wix.com Ltd and its affiliates, who process data on our behalf as part of running the webshop.
4.3 Delivery data is shared with FedEx, our shipping carrier, to deliver your order.
4.4 Meta Platforms, the company behind the Meta/Facebook Pixel, receives data as described in Article 2.4 and 3.2, only where you have consented to marketing cookies.
4.5 We do not sell personal data to third parties, and we only share what is needed for the purposes described in this policy.
Article 5. Data transferred outside the EEA
5.1 Meta Platforms is certified under the EU-US Data Privacy Framework, which the European Commission currently recognises as providing an adequate level of protection for data transferred to the United States. This framework is presently valid, though it remains the subject of ongoing legal challenges in the EU, including a case pending before the Court of Justice of the European Union. We monitor this and will update our practices if the framework changes.
5.2 FedEx is a globally headquartered carrier. Deliveries within the Netherlands are handled by its European operations, and where data is processed outside the European Economic Area as part of that relationship, we rely on appropriate safeguards such as standard contractual clauses approved by the European Commission.
5.3 Where any other provider we use processes data outside the European Economic Area, we rely on the same kind of appropriate safeguards.
Article 6. How long we keep your data
6.1 Order and invoice data is kept for at least 7 years, in line with Dutch fiscal record keeping obligations.
6.2 Newsletter data is kept until you unsubscribe.
6.3 Cookie data is kept for the period stated in our cookie banner, and no longer than necessary for the purpose it was collected for.
Article 7. Your rights
7.1 Under the AVG/GDPR, you have the right to request access to, correction of, or deletion of your personal data, to restrict or object to processing, to request data portability, and to withdraw consent at any time without affecting processing carried out before withdrawal.
7.2 To exercise any of these rights, contact us at info@birdjk.com. We will respond within one month.
7.3 You also have the right to lodge a complaint with the Dutch Data Protection Authority, the Autoriteit Persoonsgegevens, at autoriteitpersoonsgegevens.nl.
Article 8. Security
We take appropriate technical and organisational measures to protect your data against loss or unauthorised access, and require our providers to do the same.
Article 9. Changes to this policy
We may update this policy from time to time, for example when we add a new tool or provider. The version published on birdjk.com is always the current one.
